Anti-Spam & Email Marketing Policy

1. Our Commitment
Terra Connect Ltd is committed to sending marketing and commercial communications only to those who have given valid consent or who have a legitimate expectation of receiving them. We comply fully with the Privacy and Electronic Communications Regulations 2003 (PECR), the UK General Data Protection Regulation (UK GDPR), and the Data Protection Act 2018.
We have a zero-tolerance policy for spam. We will never send unsolicited bulk email or engage in any practices that constitute spam under UK law.
2. Legal Basis for Marketing Emails
We send marketing emails only where we have a valid legal basis under PECR and UK GDPR:
a) Explicit Consent
Where you have actively opted in to receive marketing communications from us (e.g. by ticking an opt-in box on a form), we rely on your explicit consent. Consent is:
- Freely given (not bundled with other consents or made a condition of service)
- Specific (you know what you are consenting to receive)
- Informed (we tell you who we are and what we will send)
- Unambiguous (via a positive opt-in action, not a pre-ticked box)
b) Soft Opt-In (Existing Customers)
Under PECR Regulation 22, we may contact you with marketing about our own similar products or services if you are an existing client and:
- We obtained your email address in the course of a sale or negotiation of a sale
- We are marketing similar products or services to those you previously purchased or enquired about
- You were given a clear opportunity to opt out at the time of collection, and you did not opt out
- You are given a clear opportunity to opt out with every subsequent message
3. What We Will Never Do
- Send marketing emails to purchased, rented, or scraped email lists
- Use deceptive or misleading subject lines or sender information
- Conceal our identity in commercial communications
- Omit our postal address from marketing emails
- Send marketing by SMS or phone without prior express consent
- Continue to market to you after you have unsubscribed
- Use “cookie stuffing”, hidden pixels, or tracking methods without disclosure
4. What Every Marketing Email Contains
Every marketing email we send will include:
- Our company name: Terra Connect Ltd
- Our registered address: 57 Tonbridge Drive, Basildon, SS15 6ND, UK
- A clear, honest subject line
- A clear explanation of why you are receiving the email
- A prominent, working unsubscribe link or opt-out mechanism
- A link to our Privacy Policy
5. How to Unsubscribe
You can opt out of marketing communications at any time by:
- Clicking the unsubscribe link in any marketing email
- Emailing hello@terraconnect.co.uk with the subject “Unsubscribe”
We will honour all unsubscribe requests within 5 business days. Unsubscribing from marketing does not affect transactional emails related to services you have purchased or enquired about.
6. Retention of Consent Records
We maintain records of all marketing consents received, including the date, method, and scope of consent. These records are kept for as long as you remain a subscriber plus 2 years, to enable us to demonstrate compliance if required.
